By accessing or using the Website, Service, or purchasing Products, you agree to be bound by these Terms and our Privacy Policy, which can be found here. If you do not agree with any part of these terms, please refrain from accessing the Website or Service.

Import Duty

Please be aware that the buyer is responsible for any fees associated with import or custom duties.

In order to use this Website, you must be at least 18 years of age. If you are using LitNeon.com.au on behalf of a company, entity, or organization, you must have the necessary authority to bind it to these Terms and Conditions.

We reserve the right to amend these Terms and Conditions at any time. We will notify you of any changes by posting the updated version on this webpage and indicating the date of the last revision at the bottom of the page. Please check these Terms and Conditions regularly, as any revised versions will be considered binding on you. Any modifications will become effective upon the posting of new Terms and Conditions. Your continued use of this Website after any changes to the Terms and Conditions are posted indicates your acceptance of the modifications.

Website Availability

We have the right to modify, update, or terminate LitNeon.com.au at our sole discretion, without notice or liability, for any or no reason, at any time.

Product Availability

All LitNeon Products are custom-made to order, including those listed in the Website shop section. If you require expedited delivery, please select the 'Rush My Order' option during checkout and provide us with the desired delivery date. Rush orders are typically fulfilled within 2-3 weeks, inclusive of production and shipping to destinations within Australia. While we will make every effort to ensure that your purchased Product arrives within the specified timeframe, we cannot guarantee delivery as unforeseen circumstances beyond our control may occur. Additionally, customs clearance may extend delivery times for certain countries.

Purchases

In order to purchase any product or service available on this Website, you may be required to provide relevant information such as your name, email address, delivery address and payment details. We value your privacy and encourage you to review our Privacy Policy for detailed information on the information we collect and how it is used.

Please note that Lit Neon reserves the right to modify prices and delivery schedules at any time. Furthermore, we retain the right to decline or cancel orders at our discretion. In the event of such a refusal or cancellation, we will notify you promptly and provide a reason for the decision.

Payment and Invoicing

Lit Neon provides various payment options for our customers, depending on the product or service ordered.

For shop signs and products, payment is required at the point of sale and can be made through PayPal or a major credit card.

For custom-made signs created using our online tool, payment is also required at the point of sale and can be made through PayPal or a major credit card.

For bespoke signs designed by us, full payment is required before production can begin. Once you have approved the design, we will provide you with an invoice via email which can be paid through PayPal or a major credit card. Your sign will then proceed to production once payment has been received.

At Lit Neon, we prioritize our customers' satisfaction, and we aim to make the payment process as easy and secure as possible.

Our Design Service

At Lit Neon, we take pride in providing exceptional customer service, which is why we are pleased to offer a free design service to our valued customers. This service includes creating one or more designs for your approval, at no extra cost.

We understand that customers may occasionally change their minds or encounter unforeseen circumstances that necessitate amending or canceling their orders before production begins. In such cases, we are happy to offer a partial or full refund, as appropriate.

However, once a custom sign order has been approved and has proceeded to production, we are no longer able to offer a refund. It is important to note that an order for a custom sign is deemed approved if "NO" design proof is selected when placing the order.

We strive to deliver high-quality products and services that meet our customers' needs and exceed their expectations. Please do not hesitate to reach out to our customer service team if you have any questions or concerns regarding our design service or refund policy.

Returns & Refunds

At Lit Neon, we prioritize our customers' satisfaction and strive to deliver high-quality products. In the unlikely event that you receive a faulty product, we offer returns and refunds for such products in accordance with Australian Consumer Law. Please note that the final resolution for faulty products, including refunds for the cost of the product and/or shipping, is determined on a case-by-case basis depending on the source of the fault.

To initiate a return or refund, kindly follow the below steps:

1. Contact us at info@litneon.com.au and provide details of the products you wish to return and the reason for the return, along with a short video of the faulty sign as well as photos. Please note that we require both a video and photo(s) for diagnostic and quality purposes. Inability to provide both a video and photo(s) of the problem may limit our ability to rectify your issue. Once we have received all the required information, we will be in touch to try to resolve the issue.
2. If a return has been agreed, please note that you must return the faulty product in its original condition.
3. If a return has been agreed, the faulty item must be returned for inspection by Lit Neon within 14 days of when you received the product.
4. If a replacement has been agreed, Lit Neon will endeavor to produce and ship the replacement product to you as soon as possible.
5. If a full or partial refund has been agreed, Lit Neon will notify you of when you can expect to receive the refund.

We value our customers and are committed to providing exceptional customer service. Please do not hesitate to contact us if you have any questions or concerns.

Lit Neon® Warranty

Lit Neon products come with a 12-month warranty for electrical components, provided they are used appropriately. Please note that Indoor Signs are not suitable for outdoor use or exposure to moisture, as this will void the warranty. If your sign experiences a presumed fault, we may request photos and videos for diagnostic purposes and may require the sign to be sent back to us for replacement or repair. Please note that Lit Neon bears no responsibility for costs incurred when installing and/or uninstalling your sign, and it is at our sole discretion to decide if the occurring fault is covered under our 12-month warranty if the sign has been hardwired in by an electrician.

Please be advised that according to our company policy, returns are only accepted for products exhibiting visible signs of breakage or damage. Regrettably, items damaged due to short circuits fall outside the scope of our return policy. We appreciate your understanding and cooperation in this matter.

Damaged in Transit

We advise all customers to inspect their Lit Neon sign upon delivery. In the rare occurrence of any damage during transit, Lit Neon is committed to resolving the issue promptly.

To be eligible for a replacement, damage must be reported within 14 days of delivery. Any damage or faults reported after this time period will not be covered under warranty. Please note that the delivery date is determined by the courier delivery date, which can be found by following the prompts in your tracking email.

If you suspect that your item has been damaged during transit and you are still within the 14 day claim period, kindly send an email to your LED Neon Designer or info@litneon.com.au, providing clear photos of the following:

1. The damage to the sign,
2. Any damage to the outer box, and
3. The shipping label on the box

Lost, Missing & Stolen Signs

At Lit Neon, we understand the importance of ensuring that our customers receive their orders in a safe and timely manner. For this reason, we use a premium express shipping service that requires a signature on delivery. If, however, a customer chooses to opt-out of the signature on delivery requirement through the shipping service, Lit Neon will not be held responsible for any lost, missing, or stolen parcels that have been marked as "delivered" by the shipping service. We advise our customers to carefully consider this option and understand the associated risks.

Lit Neon® Gift Cards

Lit Neon offers Gift Cards that can be redeemed for various products and services, including making a custom sign using our online design tool, purchasing items from our Shop, and ordering neon art custom made by sending a quote request to our team. These Gift Cards are valid for 3 years from the date of purchase and cannot be redeemed for any purpose other than purchasing products from Lit Neon.

Please note that Gift Cards may not be used in conjunction with any other discounts or promotions, and cannot be purchased using discount codes or other promotional offers. Lost or stolen Gift Cards will not be replaced or refunded, and Gift Cards cannot be cancelled or refunded once purchased.

If you purchase a product using a Gift Card, you may only return it in accordance with Lit Neon's Returns & Refunds policy. Exchanges are not permitted for products purchased solely or partially with a Gift Card.

Gift Cards must be used in a single purchase and no credit will be given for any remaining value on the Gift Card. It is your responsibility to ensure the safe use of your Gift Card, and you will be liable for all transactions made on your Gift Card except in cases of fraud or negligence by Lit Neon or its employees

Copyright and Trademarks

By using the Lit Neon Online Design Tool and/or Logo/Image Uploader, you agree not to engage in any activities that promote bigotry or discrimination against protected classes, support or glorify hatred or violence, create or promote illegal content, or violate any third-party rights, including intellectual property or proprietary rights. Additionally, you agree not to violate these Terms and Conditions or any applicable law.

Lit Neon reserves the right to refuse service and take legal action against anyone who uses the Online Design Tool and/or Logo/Image Uploader in a manner inconsistent with the restrictions listed above.

Use of the LitNeon.com.au website

We grant you permission to use this Website subject to the restrictions in these Terms and Conditions.

Restrictions on Use

• Lit Neon has established certain restrictions on the use of its website, LitNeon.com.au. As a user, you agree not to engage in the following activities, and also agree not to assist or enable others in doing so.

• Interfering with the use of LitNeon.com.au by another user through actions such as threatening, stalking, defrauding, harassing, advocating harassment, or any other form of interference.
• Using LitNeon.com.au for mass messaging, such as spam, chain letters, contests, junk email, pyramid schemes, surveys, or any other commercial or non-commercial messaging.
• Using LitNeon.com.au for promotional or commercial purposes, unless explicitly authorized in writing by Lit Neon.
• Engaging in any activity on LitNeon.com.au that may create a conflict of interest.
• Promoting bigotry or discrimination against protected classes through the use of LitNeon.com.au.
• Violating any third-party rights, such as copyright, trademark, patent, trade secret, moral right, privacy right, right of publicity, or any other intellectual property or proprietary right.
• Creating or promoting pornography or illegal content through the use of LitNeon.com.au.
• Violating the Terms and Conditions or any applicable law through the use of LitNeon.com.au.
• Modifying, adapting, appropriating, reproducing, distributing, translating, creating derivative works or adaptations of, publicly displaying, selling, trading, or exploiting Lit Neon Products or LitNeon.com.au Content, except as explicitly authorized by Lit Neon.
• Reverse engineering any portion of LitNeon.com.au, except where permitted by law.
• Removing or modifying any copyright, trademark, or other proprietary rights notice on LitNeon.com.au or any materials printed or copied off of LitNeon.com.au.
• Using any robot, spider, site search/retrieval application, or other automated device, process, or means to access, retrieve, scrape, or index LitNeon.com.au or any LitNeon.com.au Content without permission from Lit Neon.
• Reformatting or framing any portion of LitNeon.com.au.
• Taking any action that imposes an unreasonable or disproportionately large load on LitNeon.com.au's technology infrastructure, or otherwise disrupts the proper working of LitNeon.com.au.
• Attempting to gain unauthorized access to LitNeon.com.au, user accounts, computer systems, or networks connected to LitNeon.com.au through hacking, password mining, or any other means.
• Using LitNeon.com.au or any LitNeon.com.au Content to transmit any computer viruses, worms, defects, Trojan horses, or any other items of a destructive nature (collectively, "Viruses").
• Using any device, software, or routine that interferes with the proper working of LitNeon.com.au, or otherwise attempts to interfere with the proper working of LitNeon.com.au, such as by making excessive traffic demands.
• Violating the security of any computer network through the use of LitNeon.com.au, such as by cracking passwords or security encryption codes, or by disrupting or interfering with the security of LitNeon.com.au or LitNeon.com.au Content.
• Removing, circumventing, disabling, damaging, or otherwise interfering with any security-related features of LitNeon.com.au, features that prevent or restrict the use or copying of LitNeon.com.au Content, or features that enforce limitations on the use of LitNeon.com.au
